1. AGE RESTRICTION & ADULT SIGNATURE LIABILITY

YOU MUST BE OF LEGAL DRINKING AGE IN YOUR JURISDICTION (21+ IN THE USA) TO BE ON THIS SITE.

By interacting with FreakyIce.com, you certify under penalty of perjury that you meet the minimum legal drinking age in your state. Falsifying your age to purchase alcohol is a criminal offense and will be prosecuted to the absolute maximum extent of the law.

DELIVERY REQUIRES A VALID GOVERNMENT-ISSUED ID AND THE PHYSICAL SIGNATURE OF AN ADULT OVER 21. If delivery cannot be completed because a person of legal drinking age is not present, the shipment will be returned, and you will unconditionally forfeit all shipping costs and be subjected to a $45.00 mandatory restocking fee. We assume zero liability for delayed access or failed deliveries resulting from your failure to produce a valid ID.

2. VIP AUTOSHIP & CONTINUITY BILLING (ROSCA COMPLIANCE)

By enrolling in the Freaky Ice VIP Autoship program, you expressly authorize Freaky Ice and its authorized payment processors (e.g., Stripe) to automatically initiate recurring charges to your saved payment method on the frequency specified at checkout without further authorization.

Auto-Renewal: Your subscription will renew perpetually until actively terminated by you.
Cancellations: You possess the right to cancel your subscription at any time via your digital user portal. However, to halt the processing of an upcoming charge, cancellations MUST be submitted no later than 72 hours prior to the next billing date. Failure to terminate effectively before this threshold authorizes the transaction and subsequent fulfillment. Such transactions are final, non-refundable, and immune to dispute.
Price Modification: We reserve the right to alter the price of our subscription program at any time with a 30-day advance electronic notice. Continued engagement signifies binding acceptance of new terms.

3. BINDING ARBITRATION & CLASS ACTION WAIVER

PLEASE READ CAREFULLY—THIS MATERIALLY AFFECTS YOUR LEGAL RIGHTS.

By agreeing to these Terms, you and Freaky Ice unequivocally agree to resolve any and all claims, disputes, or liabilities arising out of your relationship with the brand, your use of the Website, or the purchase and consumption of our products solely and exclusively through final, binding, and individual arbitration, entirely overriding the right to pursue litigious actions in a court of law or before a jury.

CLASS ACTION WAIVER: You further agree to relentlessly waive your right to participate in a class action lawsuit, class-wide arbitration, or any other representative action. The arbitrator may not consolidate more than one person's claims.

4. LIMITATION OF LIABILITY & INDEMNIFICATION

IN NO EVENT AND UNDER NO LEGAL OR EQUITABLE THEORY, WHETHER IN TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL FREAKY ICE, ITS AFFILIATES, ITS EXECUTIVES, OR ITS RETAIL PARTNERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, SPECIAL, INCIDENTAL, EXEMPLARY, PUNATIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE SITE OR THE CONSUMPTION OF ITS PRODUCTS, INCLUDING BUT NOT LIMITED TO LOST PROFITS, THIRD-PARTY LIABILITIES, OR ALCOHOL-RELATED INJURIES.

You agree to aggressively defend, indemnify and completely hold harmless Freaky Ice from any claims, liabilities, damages, judgments, and expenses (including exorbitant attorney's fees) arising out of your violation of these strict Terms or your unlawful use of the Service.

5. ORDER CANCELLATION & PRICING ERRORS

We reserve the sovereign right to refuse, limit, or cancel any order placed on our platform for any reason, particularly in cases of suspected fraud, unauthorized high-volume resale attempts, or typographical pricing errors. If your order is canceled post-charge, a full refund will be initiated immediately.

6. INTELLECTUAL PROPERTY & BRAND SOVEREIGNTY

All visual assets, algorithms, copy, proprietary formulations, and branding architectures on FreakyIce.com are the exclusive intellectual property of Freaky Ice. Unauthorized scraping, recreation, or distribution of our brand assets is strictly prohibited and will result in immediate legal action.

7. GOVERNING LAW

These Terms and and all transactions are constructed and governed ruthlessly in accordance with the laws of the State of Florida, deliberately ignoring any conflict-of-law principles. Use of this site implies absolute submission to the personal jurisdiction of Miami-Dade county processing arenas.
